CCTV Provides Vital Evidence in Compensation Claim
Jenny was walking through a busy shopping centre when she was knocked to the ground and suffered significant shoulder injuries. She believed that she had been knocked down by a security guard who was chasing a shoplifter. We advised Jenny that if she had been knocked down by the security guard then there would be a claim against the insurers of his company. The security company were adamant that Jenny had been knocked down by the shoplifter and this would only entitle her, potentially, to a much lower level of compensation through the Criminal Injuries Compensation Authority.
The security company produced statements from their guards who were adamant that the shoplifter had ran into Jenny. Poor quality CCTV evidence from the shopping centre was inconclusive but it was eventually possible to track down far clearer CCTV evidence from a nearby shop which showed that it was the security guard who had collided with Jenny and knocked her to the floor. The insurers of the security company have now admitted full liability and Jenny will receive compensation. But for the CCTV evidence obtained from the nearby shop the claim may well have failed.
